This policy explains what information ConstraintIQ collects when you submit a Fit Check request or otherwise interact with us, how we use that information, how we protect it, and the rights you have. We keep it short and direct.

1. What we collect

ConstraintIQ LLC is an Alaska limited liability company that provides permitting intelligence, regulatory analysis, and environmental consulting services for energy infrastructure. When you submit a Fit Check request or correspond with us, we collect only what you provide:

  • Name and work email address
  • Company name and phone number (if provided)
  • Role, geography, project type, and urgency
  • Project description, including location, scope, phase, and areas of uncertainty you choose to share
  • Supporting documents or project materials you choose to provide via email or direct correspondence

We do not collect payment information through the Fit Check form. Billing, when applicable, is handled separately under the engagement agreement.

The Fit Check form on our site submits your information directly to our intake system, which is hosted on Google infrastructure as part of our Google Workspace environment. We do not use an embedded third-party form builder, advertising cookies, or cross-site tracking. Regardless of the tools we use to receive and store submissions, we do not engage in behavioral profiling of visitors and we do not sell or share your personal information with third parties for their own marketing purposes.

Our website hosting provider has web analytics enabled. This collects aggregated, anonymized data about how visitors use the site, including page views, referring URLs, general geographic region, and device and browser type. It does not use cookies, does not store IP addresses, and does not track visitors across sites or collect personally identifiable information. Data is used solely to understand site performance.

2. How we use it

We use the information submitted through the Fit Check form solely to:

  • Assess whether ConstraintIQ is a fit for your project and respond with a determination
  • Scope and deliver a permitting intelligence brief if an engagement proceeds
  • Administer the engagement, including communications, invoicing, and record-keeping
  • Improve the accuracy of our internal knowledge base, using de-identified or aggregated information consistent with applicable law
  • Comply with our legal, regulatory, and professional obligations

We do not sell, rent, or share your personal information with third parties for marketing purposes.

3. AI and automated processing

Our services rely on structured analysis of permitting and regulatory information. We use software tools, including automated search and retrieval systems and, in limited cases, large language models, to assist our analysts. We apply the following commitments to any automated processing that touches Fit Check content:

  • Human review. A ConstraintIQ analyst reviews any determination or deliverable before it is sent to you.
  • No training on your data. We do not use your submissions or project documents to train or fine-tune any machine-learning model. Our model providers commit under their terms of service that inputs submitted via their API are not used for model training.
  • Limited provider access. Where a third-party model provider processes content on our behalf, it acts as our service provider under an agreement that prohibits independent use of the content.
  • No solely automated decisions. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing.

4. How it's stored

Your submission is stored in internal business systems with access limited to ConstraintIQ personnel who need it to deliver the engagement. Security measures include:

  • Encryption of data in transit and at rest using industry-standard algorithms
  • Role-based access controls and multi-factor authentication for administrative accounts
  • Activity logging and periodic access review
  • Personnel bound by written confidentiality obligations

We use established service providers for cloud hosting, domain services, transactional email, document storage, business productivity, and form handling, including Google Workspace for email and form intake. We select providers whose paid-plan terms of service restrict the use of your information to delivering the service and prohibit use of submitted content to train machine-learning models.

5. International transfers

ConstraintIQ is based in the United States and stores information in the United States. If you are located outside the United States, submitting information to us involves a transfer to the United States. We handle all information in accordance with this policy and applicable U.S. law.

6. Retention

We retain information only for as long as needed for the purposes described above:

  • Contact information (name, email, company, phone): for the duration of the relationship and up to two (2) years after the last interaction, unless a longer period is required for legal or accounting purposes
  • Fit Check submissions that do not lead to engagement: up to twelve (12) months, after which they are deleted or anonymized
  • Project documents under an active engagement: returned or destroyed in accordance with the engagement agreement; working files retained for up to seven (7) years where required by professional or regulatory obligations

You may request deletion of your information at any time by emailing privacy@getconstraintiq.com. We will confirm receipt within ten (10) business days and complete the deletion within forty-five (45) days, subject to verification of your identity and any permitted retention exceptions.

7. Your rights

Depending on your jurisdiction, you may have some or all of the following rights with respect to your personal information:

  • Request a copy of the information we hold about you (right of access)
  • Request correction of inaccurate or incomplete information
  • Request deletion of your information (subject to legal or professional retention obligations)
  • Request a portable copy of the information you provided to us
  • Object to or restrict certain processing
  • Withdraw consent for future communications or processing that relies on consent, at any time

8. Security incident notification

If we become aware of a security incident that has resulted in unauthorized access to, or disclosure of, your personal information, we will notify affected individuals and, where applicable, regulators without undue delay and within the timeframes required by applicable law. Our notice will describe the nature of the incident, the information involved, the steps we are taking to contain and remediate it, and any actions you can take to protect yourself.

9. Public and government information

Our services frequently involve information that is already publicly available through government permitting records, environmental impact filings, regulatory dockets, and similar sources. Information that is lawfully in the public domain or independently available from government sources is not restricted by this policy and may be used by ConstraintIQ consistent with applicable law, including for the delivery of our services and the improvement of our internal processes.

10. Business confidentiality

We treat Fit Check submissions, including project documents, with professional business confidentiality and do not disclose them outside of ConstraintIQ personnel and service providers involved in evaluating or delivering the engagement. Formal contractual non-disclosure protection applies only once an engagement agreement or mutual non-disclosure agreement is signed.

If you would like to work under a mutual NDA before sharing detailed project information, tell us at the Fit Check stage and we will put one in place before you share specifics.

11. Children

ConstraintIQ's services and website are directed to businesses and are not intended for children. We do not knowingly collect personal information from children under the age of 16. If you believe a child has provided personal information to us, contact us and we will delete it.

12. Changes to this policy

We may update this policy from time to time. If we make a material change, we will update the effective date above and, where appropriate, provide additional notice. We encourage you to review this policy periodically. The version in effect at the time of your submission governs that submission.

13. Governing law

This policy is governed by the laws of the State of Alaska, without regard to conflict-of-laws principles. Any dispute arising under this policy that cannot be resolved informally shall be brought exclusively in the state or federal courts located in the Third Judicial District of the State of Alaska.
